El trabajo reflexiona sobre el principio de división de poderes y su evolución en el tiempo, frente al ejercicio del control de convencionalidad por parte de la Corte Interamericana de Derechos Humanos (Corte IDH). Se interroga sobre si los alcances del control pueden, por sobre la finalidad de proteger los derechos y garantías de la Convención Americana sobre Derechos Humanos, incursionar en diseños estructurales de las Constituciones que forman parte de su identidad constitucional.
The work reflects on the principle of division of powers and its evolution over time, in the face of the exercise of conventionality control by the Inter-American Court. It questions whether the scope of control can, beyond the purpose of protecting the rights and guarantees of de CIDH, penetrate the structural designs of the Constitutions that are part of its constitutional identity.
