El control de convencionalidad se ha ido acomodando progresivamente desde los primeros fallos de la Corte Interamericana –al igual que su homónima europea–, hasta los más nuevos, donde en general se ha notado una evolución favorable. El Tribunal interamericano hizo desde su inicio este trabajo sin decirlo expresamente, pero comparando al fin las normas internacionales con las domésticas y juzgando sobre la prevalencia de aquéllas. Empero, a partir del año 2003 en los casos “Myrna Mack Chang”, “Almonacid Arellano” y “Trabajadores Cesados del Perú”, entre otros, comenzó a usar esta lexicografía de “control de convencionalidad”, que lentamente se fue ampliando poniendo como sujetos activos, primero a los Jueces, luego al Poder Judicial y en general a los órganos vinculados con la administración de justicia, para finalmente extenderlo a todos los Poderes del Estado.
The conventionaly control has been adapting gradually since the early sentences of the Inter American Court –like its european namesake–, to newer, generally where there has been a positive trend. The Inter-American Court did in the early days this job without expressly saying so, but finally comparing international standards with domestic and judging on the prevalence of those. But since 2003 in the decisions of the cases “Myrna Mack Chang”, “Almonacid Arellano” and “Trabajadores Cesados del Perú”, among others, the Court began to use this lexicography “conventionally control”, which was slowly expanding putting as subjects active, first the judges, then the judiciary and in general organs associated with the administration of justice, to finally extend to all branches or powers of the state.
