Atento al tema del Congreso, resulta relevante el análisis jurídico del Acuífero Guaraní como reserva del recurso agua. En tal sentido, el agua se ha transformado en el recurso estratégico del Siglo XXI y, como tal, seguirá siendo fuente de conflictos. Los países más ricos del planeta tienen sus recursos hídricos subterráneos en vías de agotamiento, mientras que en los países de América del Sur, el agua dulce abunda, pero se desconoce la magnitud, cantidad y calidad de sus aguas subterráneas. Por ello se hace necesaria su protección como Derecho Humano de Tercera Generación, fundado en la solidaridad, a fin de cumplir con el mandato constitucional (art. 41) de proveer a la protección de este derecho. El Acuífero Guaraní, como reserva de agua dulce, se encuentra insuficientemente regulado por Tratados Internacionales por lo que, a nivel del Mercosur, se elaboró un Acuerdo sobre el Sistema Acuífero Guaraní, referente a la propiedad, conservación y uso del recurso ratificado solo por algunos países miembros.
Attention to the theme of the Congress, relevant legal of the Guarani aquifer analysis as a reserve of the resource water. In this regard, water has become the strategic resource of the 21st century and, as such, will continue to be a source of conflict. Of the planet's richest countries have their groundwater resources in the process of exhaustion, while in the countries of South America, fresh water abounds, but it is unknown the extent, quantity and quality of its groundwater. This need for their protection as right human's third generation, founded on solidarity, in order to comply with the constitutional mandate (art. 41) provide for the protection of this right. The Guarani aquifer, as fresh water reserve, is insufficiently regulated by international treaties by which, at the level of Mercosur, was elaborated an agreement on the Guarani aquifer system, concerning the property, conservation and use of the resource only ratified by some Member countries.
