Este trabajo está destinado a indagar la presencia de posibles vulneraciones al respeto de la capacidad progresiva y el interés superior de la niñez trans, en el acceso al derecho a la identidad de género. Se propone analizar un caso donde se obtura el acceso a la identidad a partir de la judicialización del mismo. Se hace hincapié en cómo el acceso a la identidad de género en niñeces se postula como el caso a partir del cual la judicialización define su acceso, oponiéndose a lo que propone el paradigma de protección integral de los derechos de niñas, niños y adolescentes, y a la ley de identidad de género.
This work is intended to introduce the presence of posible violations in respect of the progressive capacity and the best interests of trans children in the Access to the Right to Gender Identity. It is proposed to analyze a case where Access to identity is blocked from its judicialization. Emphasisis placed on how Access to gender identity in children is postulated as the case from which judicialization defines their access, opposing what the paradigm of integral protection of the rights of children and adolescents, and the proposing gender identity law.
