La veneración a los muertos subyace en los misterios del alma y ya sea que pretendamos encontrarla en el miedo a la muerte o en la justificación de la vida, lo cierto es que a través de la historia el hombre ha guardado en todas las épocas un respeto sagrado por la memoria de sus muertos. Sin embargo, la naturaleza jurídica del derecho de sepultura que tienen los particulares, ya sea en cementerios públicos o privados, ha sido siempre motivo de enconado debate y de la misma surgirá si los mismos pueden ser susceptibles o no de prescripción adquisitiva. Cuestiones que aquí intentaremos dilucidar, intentando, finalmente, dar nuestra opinión no solo desde el punto de vista exegético, sino también acorde a nuestros valores y principios vigentes.
The veneration of the dead underlies the mysteries of the soul, and whether we try to find it in fear of death or in the justification of life, the truth is that throughout history man has kept in all times a sacred respect for the memory of their dead. However, the legal nature of the Burial Law that individuals have, whether in public or private cemeteries, has always been the subject of fierce debate and it will emerge whether they may or may not be subject to acquisitive prescription. Issues that we will try to clarify here, trying, finally giving our opinion not only from the exegetical point of view, but also according to our current values and principles.
