El presente trabajo presenta y analiza normativas recientes que afectan al sistema educativo de la provincia de Buenos Aires, para indagar allí aquello que habla de los migrantes y de lo “intercultural”. Se trata de la Ley de Educación Nacional N° 26.206 aprobada en 2006; la Ley de Educación Provincial N° 13.688, de 2007; y la reforma del artículo 57 del Estatuto Docente (2008), que permite a los extranjeros trabajar como docentes en la provincia de Buenos Aires. Desde una concepción de la ley como producto social, este análisis de la normativa constituye uno de los pasos de un proyecto que pretende avanzar hacia las prácticas y discursos de los distintos actores que participan en el cotidiano escolar, para vislumbrar —entre otras cuestiones— la distancia entre estas prácticas y discursos y lo propugnado en los textos legales, en lo referente a migraciones e interculturalidad.
The present paper presents and analyzes recent regulations that affect the educational system of the province of Buenos Aires, to inquire there what speaks of migrants and of “intercultural”. These are the law on National Education number. 26.206 (of the year 2006), the Provincial law on Education number. 13.688 (from the year 2007), and the reform of article 57 of the Teaching Statute (from 2008), which allows foreigners to work as teachers at the Buenos Aires province. From a conception of law as a social product, this analysis of the regulations is one of the steps in a project that aims to advance over practices and discourses of the various actors involved in the day-to-day school, and glimpse -among other issues- the distance between these practices and discourses and what is promoted in legal texts concerning interculturality and migrations.
