Dilemas éticos, jurídicos y psicológicos de la gestación por sustitución y su resolución simbólica

El presente trabajo trata sobre la gestación por sustitución en tanto Técnica de Reproducción Humana Asistida (TRHA) en relación a la constitución y conformación de los vínculos familiares que derivan de esta práctica. Para ello, intentaremos plantear cuestiones que se presentan como controversiales, tanto en el campo jurídico como en el psicológico, para finalmente establecer en agenda un área que se presenta como novedosa, dilemática y de actualidad. A los fines de explorar, investigar y trabajar los posibles efectos que se suscitan de dicha práctica y su impacto en la subjetividad, tomaremos en consideración el caso de dos hermanas que se someten a esta técnica de gestación por sustitución. Conjuntamente, realizaremos un recorrido por la jurisprudencia argentina y los instrumentos normativos existentes que guarden relación con esta práctica, con el objeto de analizar la resolución jurídica de estos casos.
The present work is about the pregnancy by substitution as Technician of Assisted Human Reproduction (TRHA) in relation to the constitution and conformation of the family bonds that derive from this practice. To do this, we will try to raise issues that are presented as controversial both in the legal and psychological fields to finally establish in the agenda an area that is presented as novel, dilemmatic and current. For the purpose of exploring, investigating and working on the possible effects that arise from such practice and its impact on subjectivity, we will take into consideration the case of two sisters who submit this technique of replacement pregnancy. Together, we will take a tour of the Argentine jurisprudence and the existing normative instruments that are related to this practice in order to analyze the legal resolution of these cases.
