Alternativas a la propiedad liberal durante el primer peronismo: función social y cooperativismo en el ambiente constituyente argentino de 1949

Resumen: Esta contribución, fundada en la consulta directa de fuentes éditas e inéditas, se dirige a cuestionar algunos criterios historiográficos relativos al derecho de propiedad consagrado por el primer peronismo al aprobar la reforma constitucional de 1949. Entre los aspectos más destacados, se llama la atención sobre el amplio clima de ideas contrario a las propuestas liberales en la materia, en el que abrevaban tanto oficialistas como no oficialistas, y en el que se inscribe la reforma; sobre las diferencias de propuestas y de criterios en la materia evidenciadas al interior del peronismo; y sobre los diferentes alcances prácticos que los contemporáneos le atribuyeron a la categoría función social de la propiedad.
Abstract: This contribution, based on the direct consultation of published and unpublished sources, is aimed at questioning some historiographic criteria related to the property right enshrined by the first Peronism when approving the constitutional reform of 1949. Among the most outstanding aspects, attention is drawn to the broad climate of ideas contrary to the liberal proposals on the matter, in which both official and non-official members drank, and in which the reform is inscribed; on the differences in proposals and criteria in the matter evidenced within Peronism; and on the different practical scopes that contemporaries attributed to the category “social function” of property.
