El presente trabajo tiene como objetivo explorar en profundidad el concepto de dignidad humana y su relación con el final de la vida, teniendo en consideración la sentencia del Tribunal Constitucional de España, que declaró la constitucionalidad de la Ley Orgánica 3/2021. Dicha ley regula la eutanasia en todo el territorio español. Esta resolución fue resultado del recurso de inconstitucionalidad 4057-2021, interpuesto por diputados del grupo parlamentario Vox contra dicha ley y, subsidiariamente, contra trece preceptos contenidos en ella. Se busca contrastar los distintos fundamentos aplicados por los magistrados que integran el Tribunal en sus respectivos votos. Por consiguiente, será de gran relevancia para lograr alcanzar una conclusión fundamentada, exponer tesis doctrinarias divergentes, relativas a la concepción y el alcance del principio de dignidad de la persona humana, y a la implementación de la eutanasia. El objetivo final de este comentario a la sentencia del Tribunal Constitucional es el de contribuir al debate sobre la dignidad humana y el final de la vida, cuestio nando la compatibilidad de la implementación de la eutanasia con respecto a los principios constitucionales y convencionales en juego. The paper aims to explore in depth the concept of human dignity and its relationship with the end of life, taking into consideration the ruling of the Constitutional Court of Spain, which declared the constitutionality of Organic Law 3/2021. That saw regulates euthanasia throughout the Spanish territory. This ruling was the result of the constitutional appeal 4057-2021, filed by deputies of the parliamentary group Vox against the aforementioned law and, subsidiarily, against thirteen provisions contained therein. The objective is to contrast the different foundations applied by the judges of the Court in their respective votes. Therefore, in order to reach a well-founded conclusion, it will be of utmost significance to present divergent doctrinal theses regarding the conception and scope of the principle of human dignity, and the implementation of euthanasia. The ultimate goal of this commentary on the Constitutional Court’s ruling is to contribute to the debate on human dignity and the end of life, questioning the compatibility of the implementation of euthanasia with constitutional and conventional principles.
