La propiedad industrial en el ámbito del Derecho penal cubano

La problemática que hoy genera la deficiente regulación de la Propiedad Industrial en la legislación penal cubana, al no contener los diferentes supuestos de hechos que tipifique las conductas antijurídicas lesivas de este bien jurídico, motiva esta investigación en la que a partir de un estudio doctrinal y exegético de la teoría del bien jurídico se aportan elementos para su adecuada configuración y tutela en sede penal, que garanticen el respeto a la seguridad jurídica. Fueron utilizados como métodos científicos los propios de las investigaciones jurídicas (el teórico y el exegético), así como los generales de las investigaciones teóricas (análisis-síntesis, inductivo-deductivo, histórico-lógico). En la investigación no se aportan las insuficiencias que tiene la configuración del bien jurídico Propiedad Industrial, sino un diagnóstico de ellas en el ordenamiento jurídico penal cubano.
The problematic that nowadays brings up the insufficient regulation of the Industrial Property in the Cuban Penal Legislation, since it doesn’t contain the different postulates of facts that that typify the harmful unlawful behavior against that juridical welfare, motivates this investigation in which, starting from a (doctrinal and exegetic) study of the Juridical Welfare Theory, propitiates elements for its proper care and configuration in its penal seat, that guarantee the respect to the juridical security. There were used as scientific methods, the ones of the juridical investigations (the theoretical and the exegetic) such as the generals of the theoretical investigations (analysis-synthesis, inductive-deductive, historical-logical). This investigation does not provide the insufficiencies that the configuration of the Industrial Property Juridical Welfare has, but a diagnosis of the Cuban Juridical Penal Ordering.
