El presente ensayo pretende describir, de manera objetiva, al contrato de donación y a la función notarial que se proyecta sobre el mismo cuando la ley o la propia voluntad posicionan al escribano o escribana para el asesoramiento y posterior confección del contrato. La oportunidad no puede hacerse esperar, pues en torno a la figura contractual y, en especial, frente a la última reforma efectivizada en el Código Civil y Comercial de la Nación según Ley 27.587/2020 se han proyectado académicamente posiciones que, distorsionando la verdad, intentaron confundir a la ciudadanía en torno a los efectos de la noble institución que hoy nos convoca.
This essay aims to describe objectively the donation contract and the notarial function that is projected on it when the law or one’s own will position the notary public for advice and subsequent preparation of the contract. The opportunity cannot be delayed, because around the contractual figure, and especially, in the face of the latest reform made in the Civil and Commercial Code of La Nación, positions have been academically projected that, distorting the truth, tried to confuse the citizenship around the effects of the noble institution that brings us together today.
