La despenalización del aborto en la Argentina

A la luz de los textos de la antropóloga Rita Segato, en este artículo se analizan los dispositivos que sustentan la falta de tratamiento legislativo de los proyectos que buscan legalizar el aborto en la Argentina. Se abordan, para esto, los sustentos simbólicos para la falta de inscripción legal de esta práctica, las tensiones que allí se despliegan, los sujetos en pugna y los terrenos de disputas. Asimismo, se analiza el papel del Estado –el traspaso del colonialismo al Estado moderno y sus implicancias en la privatización de las prácticas abortivas– y el rol de la ley como herramienta discursiva del mismo y como forma de sujeción de las mujeres.
Under the light of the texts of the anthropologist Rita Segato, this article pretends to analyze the devices that sustain the lack of legislative treatment of the projects that pretend legalize the abortion in Argentina. The text aims to view the symbolic supports to the lack of legal registration about the abortion practice, the tensions in which they are deployed, the subjects in conflict, and the presented areas disputed, too. Likewise, the text analyzes the fundamental role of the State –the transfer from colonialism to the modern state consolidation and the implicatios of the abortion practice privation– and the law as a discursive vehicle of the same, in respect the hold-down place of women.
