Sumario: Este estudio se enfoca sobre unos aspectos hasta ahora desconocidos acerca de la censura papal contra el trabajo del jurista español Juan de Solórzano Pereira, autor de la obra en dos volúmenes sobre derecho indiano Disputationes de Indiarum Iure. Poco después de la publicación de su segunda parte en 1639, la Curia romana (bajo el mandato del Papa Urbano VIII Barberini) encargó a la Congregación del Índice de Libros Prohibidos examinar dicho tratado para finalmente decretar la condena de la sección relativa al real patronato de España sobre la iglesia. Tomando en consideración las circunstancias de la censura (caso de la temprana huida de noticias orquestrada por la Congregación, distintos informes sobre la censura, etc.), este trabajo intenta llamar la atención sobre el expediente de Solórzano conservado en los archivos vaticanos y abordar la compleja relación entre España y el Papado gestada desde la primera mitad del siglo XVII en adelante.
Abstract: This study discusses aspects hitherto unknown concerning the papal censure of the work by the Spanish jurist Juan de Solórzano Pereira, author of the two-volume treatise on Derecho indiano, known as Disputationes de Indianorum Iure. Right after the publication of its second part in 1639, the Curia (under the government of Pope Urban VIII Barberini) prompted the Congregation of the Index of Forbidden Books in Rome to examine Solórzano’s seminal treatise and, eventually, condemn its section about Spain’s Royal Patronage over the Church. By looking at the circumstances of the censure (e.g. the early ‘leak’ orchestrated by the Congregation, the other reports about the censure), the present work aims at bringing scholars’ attention to the Solórzano file conserved in the Vatican archives. Considering both the reasons of the censure and the circumstances within which it developed, the present study sheds new light on the complex relationship between Spain and the Papacy in the first half of the seventeenth century and beyond.
