Resumen: Entre las numerosas proyecciones del nuevo art. 19 del cód. civil y comercial se encuentra su decisiva importancia ante la técnica conocida como "diagnóstico genético preimplantatorio" (DGP). El autor analiza las características que hoy presenta el DGP y cuáles son las consecuencias que tiene el reconocer al ser humano como persona o no ante las finalidades con las que se pretende utilizar la técnica. Al respecto, sostiene que desconocer al embrión como persona y admitir el DGP supone generar las condiciones jurídicas para una selección eugenésica de la descendencia, de graves consecuencias sociales y con respecto al bien común.
Abstract: Among the many projections of art. 19 of the cod. civil y comercial, we find its decisive importance to the technique known as "preimplantation genetic diagnosis" (PGD). The author analyzes the features of PGD today, as well as the consequences of recognizing the human being as a person or not to the purposes for which the technique is intended. In this regard, he states that ignoring the human person status of the embryo and admiting PGD involves generating the legal conditions for a eugenic selection of offspring, which would carry serious consequences for society and for the common good.
