Institución y constitución en el pensamiento de Maurice Hauriou

El artículo explora la dimensión política del pensamiento de Maurice Hauriou (1856-1929), atendiendo en especial a las relaciones entre su teoría de la institución y su teoría constitucional. Para ello, en primer lugar se problematizan problematizamos algunos de los presupuestos del llamado neoinstitucio-nalismo, enfatizando algunos rasgos olvida-dos del institucionalismo clásico. En segundo lugar, se restituye sucintamente el horizonte histórico de emergencia del instituciona-lismo europeo “clásico” reparando especial-mente en su capítulo francés, y advirtiendo la importancia del magisterio de Hauriou en la llamada escuela del derecho público de Toulouse. En tercer lugar, se restituyen los grandes trazos del pensamiento jurídico-político del maestro tolosano, caracteri-zando los fundamentos de su metodología jurídica, e introduciendo su doctrina de la superlegalidad constitucional y su defensa teórica del presidencialismo. En cuarto lugar, se aborda con mayor detenimiento el pensamiento institucional maduro de Hauriou, en el que el jurista deposita la clave comprensiva de sus desarrollos previos, con miras a discernir el problema de la naturaleza institucional del Estado. En la conclusión se recuperan los motivos ante-riores, para introducir un comentario sobre la relación entre el derecho natural y el orden social según Hauriou.
The article explores the political dimension of Maurice Hauriou's thought (1856-1929), paying special attention to the relationships between his theory of the institution and his constitutional theory. To do this, firstly, some of the theoretical and programmatic assumptions that the triumph of the behavioral revolution of American political science bequeathed to the so-called historical neo-institutionalism are question-ned. Secondly, the historical horizon of emergence of the “classical” or “ancient” European institutionalism is succinctly restored to especially repair its French chapter, warning of the importance of the Hauriou magisterium in theso-called Toulouse public law school. In the third place, the broad outlines of the legal-political thought of Hauriou are restored, characterizing the foundations of his legal methodology, and introducing his doctrine of constitutional superlegality and his theoretical defense of presidentialism. Fourthly, Hauriou's mature institutional thinking is dealt with in greater detail, in which he deposits the comprehensive key to his previous developments, in order to discern the problem of the institutional nature of the State. In the conclusion the previous reasons are recovered, to introduce a comment on the relationship between natural law and social order according to Hauriou.
