El propósito de este artículo es indagar en el tratamiento que la Responsabilidad de Proteger ha tenido en los debates de la Comisión de Derecho Internacional y los efectos que su consideración por el órgano ha tenido y puede tener sobre el desarrollo del concepto en las Naciones Unidas. En particular, se destacan los amplios debates en la Comisión sobre el tema “protección de personas en caso desastre”, que culminaron con la correcta exclusión del concepto, y la inexplicable ausencia de la RDP en la discusión de la Comisión sobre el tema “crímenes de lesa humanidad” y el proyecto de artículos redactado al efecto.
The purpose of this paper is to explore the treatment of the Responsibility to Protect (RtoP) in the debates of the International Law Commission and the effects that its consideration by that body may have on the development of the concept at the United Nations. In particular, the paper highlights the extensive discussions in the ILC on the topic of “protection of persons in the event of disasters”, culminating in the right exclusion of the concept, and the unexplained RtoP’s absence in the ILC's discussion on the topic “crimes against humanity”, and its draft articles on that matter.
