Proyecciones de la creatividad y el acto artístico en el mundo jurídico: reflexiones desde el derecho del arte

El trabajo trata la autoría y la creatividad artística en relación con sus consecuencias jurídicas, en particular, a partir de la noción de acto artístico creativo. Siguiendo la metodología y categorías propuestas por el integrativismo tridimensionalista de la teoría trialista del mundo jurídico, el estudio se aborda desde la integración de tres dimensiones. De esta manera, se desarrollan la dimensión sociológica -que comprende el acto artístico, sus elementos, su ordenación y sus límites-, la dimensión normológica -que analiza la captación del acto artístico en normas jurídicas-, y por último, la dimensión axiológica -en la cual se razona la justica en vinculación con la belleza, por un lado, con relación a las forma y clases de justicia, y por otra parte, respecto a la justicia desarrollada por el acto artístico-. De este modo, se intenta realizar un mínimo aporte para continuar construyendo el Derecho del Arte.
The paper discusses the authorship and artistic creativity in relation to juridical consequences, especially from the concept of creative artistic act. Following the methodology and categories proposed by the tridimensional integrative construction of the trialist theory of the juridical world, the research is approached from the integration of three dimensions. Thereby, we develop the sociological dimension -which includes the artistic act, its elements, its order and its limits-, the normológical dimension -which analyzes the artistic act logically conceived by norms-, and finally, the axiological dimension -in which we develop the justice in connection to the beauty, on the one hand, in relation to the justice shape and classes of justice, and on the other hand, in relation to the justice developed by the artistic act. By this way, we try to make a little contribution to continue building the art law.
