El lawfare como agenda de investigación

El objetivo del presente artículo es sintetizar los principales abordajes sobre lawfare en la academia internacional y, específicamente, analizar el modo en que se ha retomado y resignificado esa trayectoria en América Latina. En primer lugar, esto supone asumir que el lawfare tiene una agenda en construcción, identificando las diferentes perspectivas sobre la cuestión y abriendo interrogantes para cada línea de abordaje. En segundo lugar, hacemos una propuesta de posible definición operativa de lawfare, atendiendo a la casuística concreta en que se ha utilizado en el último tiempo, y apuntando condiciones necesarias y suficientes para identificar procesos de este tipo a partir de la experiencia Latinoamericana. El texto se cierra retomando algunos interrogantes planteados en el primer apartado y adelantando algunas futuras líneas de análisis, necesarias para profundizar en el lawfare como campo en construcción.
The goal of this article is to synthesize the main approaches to lawfare in the international academy and, specifically, consider the way in which that trajectory has been retaken and redefined in Latin America. In the first place, assuming that lawfare is an agenda under construction, we identify the different perspectives on the issue, elaborating questions for each approach. Second, we make a proposal for an operational definition of lawfare, taking into account the specific casuistry in which it has been used in recent years, and pointing out necessary and sufficient conditions to identify processes of this kind. The paper ends by taking up some questions raised in the first section and posing some lines of analysis necessary to go deep into lawfare as a field under construction.
