En el artículo los autores realizan el estudio histórico-lógico de la eximente del miedo insuperable y el diagnóstico de las deficiencias que se advierten, tanto en su configuración normativa como en relación a su interpretación y aplicación en la práctica judicial cubana. No pretende ser un tratado exhaustivo ni abarcador de todos los elementos doctrinales asociados al miedo insuperable como eximente de la responsabilidad penal. Existen numerosas obras dedicadas al tema y ello excedería los propósitos de esta. Como resultado se propone un conjunto de presupuestos teóricoprácticos encaminados al perfeccionamiento normativo de la institución y su adecuada aplicación, que dotarían de mayor garantía al ordenamiento penal cubano.
In the article, the authors carry out the logical historical study of the grounds for acquittal of the insuperable fear, and the diagnosis of the noticeable shortcomings; so as, their interpretation and application in the Cuban judicial practice. This article is not intended to be an exhaustive treatise covering all theories related to the insuperable fear as a ground for acquittal on penal offense responsibility. On the other hand, there are numerous papers based on this topic which overcome the present work purpose.To conclude, a group of theoretical-practical criteria are proposed aiming at the improvement of the regulations of the institution and their appropriate application which provide greater order to the Cuban penal code.
