El artículo examina las proyecciones de la humanización del derecho respecto de la oralidad civil y de las funciones del juez civil. El proceso judicial, como medio para la resolución de conflictos, debe garantizar la tutela efectiva de los derechos y libertades de los justiciables, conforme a los sistemas de Derechos Humanos. Partiendo de ese marco, se analiza el proceso civil oral, comparándolo con el modelo escrito y destacando su capacidad para brindar una protección más eficiente a los derechos fundamentales. Luego se hace foco en el rol del juez civil en los procesos orales, subrayando su función como garante de una justicia imparcial, pronta, transparente y respetuosa de la dignidad humana. Se argumenta que la oralidad no solo mejora la eficiencia procesal, sino que también contribuye a construir una Justicia más humana.
This article explores the humanization of law within the context of civil oral proceedings and the role of the civil judge. The judicial process, as a disputes resolution mechanism, must guarantee the effective protection of the rights and liberties of litigants, in accordance with human rights systems. Based on this framework, the civil oral process is analyzed, comparing it with the written model and highlighting its capacity to provide more efficient protection of fundamental rights. Subsequently, the focus is placed on the role of the civil judge in oral proceedings, underscoring their function as guarantor of impartial, prompt, transparent, and respectful justice towards human dignity. It is argued that orality not only improves procedural efficiency but also contributes to building a more humane justice system.
