Recién a partir del último tercio del siglo XX el mundo comenzó a tomar conciencia de la gravedad del deterioro que el hombre había causado a la naturaleza y al ambiente en el que vivía. Esa preocupación hizo que se adoptaran una serie de instrumentos internacionales que dieron lugar a la globalización de la tutela ambiental del mismo modo que con anterioridad había surgido la globalización de la protección de los derechos humanos. En este trabajo daremos cuenta someramente de algunas intervenciones de Comisión Interamericana de Derechos Humanos y de la Corte Interamericana de Derechos Humanos en las que haya estado en juego la protección del ambiente o sus componentes, con una perspectiva de derechos humanos, procurando hacer una selección que resulte representativa de diversas temáticas y Estados del hemisferio; y también de los últimos avances en América Latina y el Caribe en pos de la adopción de un instrumento regional que asegure la implementación de los llamados “derechos de acceso” en materia ambiental.
Only in the last third of the 20th century, man began to become aware of the seriousness of the damage that he had caused to nature and to environment. This concern led to the adoption of different international instruments that gave rise to the globalization of environmental protection in the same way that the globalization of the protection of human rights had previously arisen. In this paper we will outline some measures which have been adopted by Inter‐ American Commission on Human Rights and Inter‐American Court of Human Rights in which protection of the environment or its components has been at stake, with a human rights perspective, trying to make a representative selection of different issues and, in turn, where different hemisphere´s states were involved; and we will also briefly refer to the latest developments in Latin America and the Caribbean in pursuit of the adoption of a regional instrument to ensure the implementation of so‐called ʺaccess rightsʺ in environmental matters.
