Importancia de la protección patrimonial local: herramientas del Derecho Ambiental aplicables al patrimonio cultural edificado

El trabajo pretende mostrar un aspecto de la tutela jurídica de los bienes del patrimonio cultural de la ciudad de La Plata, tema que incumbe al Estado y a la comunidad porque está vinculado al denominado “Derecho al patrimonio ambiental-cultural” cuya consagración en nuestro ordenamiento jurídico, reconoce diversas fuentes (ambientalismo y constitucionalismo cultural), lo que trasunta en nuestra realidad local —integrada por diversos elementos no sólo materiales sino también culturales—, en una estructura donde las relaciones que en ella se producen, están en permanente cambio, haciendo posible observar que las herramientas de protección pueden serle aplicable. Estos aportes son una aproximación a los resultados de observación y análisis efectuados en marco del Proyecto de investigación J-158/16-17 denominado: “Nuevas normas ius privatistas: simetrías o asimetrías con el régimen del patrimonio ambiental-cultural, su repercusión en el desarrollo y la gobernanza” aprobado y financiado por la UNLP.
The paper aims to show an aspect of the legal protection of the cultural heritage assets of the city of La Plata, an issue it is up to the State and the whole community, but linked to the so-called “Right to environmental and cultural heritage”, which is enshrined in our normative system, recognizes various sources (environmentalism and cultural constitutionalism), that transcends in our local reality - integrated by diverse elements not only material but also cultural - forming a structure where the relationships that occur in it, are constantly changing and it is important to analyze the protection tools that may be applicable. These contributions provide a first approximation to the results of the observation and analysis, in the framework of research project J-158 / 16-17: “New ius privatists standards: symmetry or asymmetry with the regime of the environmental-cultural heritage, its impact on development and governance” approved and financed by the UNLP.
