L’humanisme à l’aune du droit international

Plusieurs défis renvoient actuellement au repositionnement de l’humanisme comme un socle fondateur et protecteur du droit international contemporain. Toutefois, la dimension humaine du droit international se trouve facilement entravée par l’absence d’une définition claire de ce concept au sein d’un ordre juridique caractérisé essentiellement par les rapports de forces, les tensions et les crises chroniques. Cet état de fait a exigé une délimitation théorique et conceptuelle de l’humanisme à travers l’analyse des normes internationales et les discours de la doctrine pour établir les contours de cet humanisme sous-jacent au droit international à la lumière des défis de la société internationale. Dès lors, l’humanisme s’avère être un référentiel indispensable et un stimulant normatif du système juridique international. Le développement du réseau normatif international ne peut se faire sans le rôle contingent de ce marqueur normatif.
Several challenges currently refer to the repositioning of humanism as a founding and protec-tive base of contemporary international law. However, the human dimension of international law is easily hampered by the absence of a clear definition of this concept within a legal order characterized essentially by power struggles, tensions and chronic crises. This state of affairs required a theoretical and conceptual delimitation of humanism through the analysis of inter-national standards and the discourse of doctrine to establish the contours of this humanism underlying international law in the light of the challenges of international society. Humanism, therefore, turns out to be an essential repository and a normative stimulant of the international legal system. The development of the international normative network can be done without the contingent role of this normative marker.
