Resumen: El siguiente ensayo analiza la naturaleza jurídica del Reglamento de Propiedad Horizontal, para así determinar si ante la existencia de cláusulas abusivas se podrían aplicar al Régimen de Propiedad Horizontal, los principios y las normas de la Ley de Defensa del Consumidor. Para ello, nos preguntamos qué es un contrato de adhesión, cuáles son sus caracteres, y cuál es su incidencia en el instituto señalado. A partir de ello, se trae a colación el instituto de la tutela del consumidor inmobiliario, que nos brinda un amplio paraguas de protección legal y tiene gran incidencia no solo en nuestros ámbitos académicos, sino también en el día a día de la sociedad toda. Finalmente, se estudia la incidencia del principio protectorio de la buena fe en las cláusulas reglamentarias, dándonos el puntapié inicial para estudiar –y por qué no ejemplificar– cláusulas en las que el contratante dominante consigue incluir previsiones que alteran las recíprocas posiciones de las partes vinculadas, generando un notable y ostensible desequilibrio de los derechos acordados.
Abstract: This essay analizes the legal nature of the Horizontal Regulation, in order to determine, given the existence of unfair contractual terms, that the principles and rules of the consumers protection could be applied to the real legal Estate system. Therefore, we ask ourselves what is an adhesion contract? What characters does it have? And what influence does it have in the Institute indicated? On that basis, it brings up to our attention the real Estate consumer tutelage institute, which gives us a broad defiance to legal regulation, and has a large impact not only among the academic field, but also in society dayto- day life. Lastly, the influence of the good faith principle at the co-property regulation is studied, giving us the starting point to study and exemplify clauses stipulated under which the dominant contract party includes contractual terms that alter or disturb their respective positions, and break the balance of their rights and obligations.
