Resumen: La ley española de salud sexual y reproductiva y de la interrupción voluntaria del embarazo implica un importante cambio en la regulación del aborto: establece un sistema de aborto a petición en un plazo, manteniendo determinadas indicaciones durante más tiempo. Este artículo analiza la salud sexual y reproductiva, los derechos de la mujer y la protección del no nacido en el Derecho Internacional, así como la jurisprudencia constitucional española, la diferencia entre el sistema de plazos y el de supuestos, la ética médica al respecto, el consentimiento informado y la cuestión del consentimiento de los menores al aborto.
Abstract: The Spanish law on sexual and reproductive health and voluntary termination of pregnancy implies an important change regarding abortion regulations: it establishes an uponrequest abortion system within a term, maintaining certain indications during a longer period. This article analyses women´s reproductive and sexual health, their rights and the protection of the unborn within the framework of the International Law, the Spanish constitutional jurisprudence, the difference between the system of terms and that of assumptions, the medical ethics involved, the informed consent and the question of minors’ age for consent to abortion.
