Resumen: El presente texto se propone comprender los principios y el paradigma atropológico que subyacen en la regulación de las relaciones de familia en el libro II del nuevo Código Civil y Comercial argentino. Consiste en una aproximación filosófico jurídica al tema que indaga sobre los fundamentos de las instituciones jurídicas. Respecto al sistema del Código anterior, la reforma ha introducido algunos cambios sustanciales tales como la separación entre sexualidad-matrimonio y entre matrimonio-procreación; la desaparición de la dicotomía hombre-mujer como condición del ser humano y de su identidad; la instauración de una institución matrimonial reducida a una única dimensión contractual. Esta reforma parece que ha diseñado una realidad familiar frágil, donde el único interés se encuentra en el individuo y su autonomía.
Abstract: This paper aims to understand the principles and the antrophological paradigm underlying the regulation of family relations in Book II of the new Argentine Civil and Commercial Code. It is a philosophical approach to the subject legal investigates the foundations of legal institutions. Regarding the above code system, the reform has made some substantive changes such as the separation between sexuality and marriage, between marriage-procreation; the disappearance of the male-female dichotomy as a condition of the human being and identity; the establishment of a marriage institution contractual reduced to a single dimension. This reform seems to have designed a fragile family situation, where the only interest, housed in the individual and their autonomy.
