En el marco del vigésimo quinto aniversario de la primera sentencia que la Corte Suprema de Justicia de la Nación emitió en un caso de restitución internacional (“Wilner, Eduardo Mario c/ Osswald, María Gabriela”), el presente trabajo se propone, por un lado, plantear la interrogante sobre si es adecuada la terminología que cotidianamente se emplea en esta materia y, por otro, reflexionar acerca de los aportes conceptuales propuestos por la doctrina especializada. Es así como en este momento especial para el derecho constitucional, el derecho de familia y el derecho internacional privado, que son los campos en los que se enmarca la referida temática, este artículo pretende reflexionar sobre cuál es la terminología más ajustada en esta materia y el fundamento de su elección.
Within the framework of the twenty-fifth anniversary of the first judgment issued by the Supreme Court of Justice of the Nation in a case of international restitution (“Wilner, Eduardo Mario v. Osswald, María Gabriela”), the purpose of this paper is, on the one hand, to raise the question of whether the terminology used daily in this matter is adequate and, on the other hand, to reflect on the conceptual contributions proposed by the specialized doctrine. Thus, at this special moment for Constitutional Law, Family Law and Private International Law, which are the fields in which the referred subject matter is framed, this article intends to reflect on which is the most appropriate terminology in this matter and the basis for its choice.
