Resumen: El comentario analiza dos sentencias referidas a la colisión de derechos fundamentales en una sociedad democrática multiétnica y multicultural. Por un lado, la sentencia «S.A.S. v. France» de la Corte Europea de Derechos Humanos, en la que primó la seguridad pública y los valores de la sociedad francesa por sobre la libertad de usar niqab por la actora. Por otro, la sentencia «EEOC v. Abercrombie & Fitch Stores, Inc.» de la Corte Suprema de Estados Unidos, en la cual se reconoció a la demandante su derecho a usar el velo, por sobre el de libertad de contratación de la empresa. Se concluye que aún está en debate si se le deben imponer las reglas del país a los migrantes o si los países receptores se deben acomodar a las nuevas costumbres
Abstract: The commentary analyzes two judgments that address the collision of fundamental rights in a multiethnic and multicultural democratic society. First, the judgment «S.A.S. v. France» of the European Court of Human Rights, in which public security and the values of the French society prevailed over the freedom of the plainti- of wearing a niqab. On the other hand, the judgment «EEOC v. Abercrombie & Fitch Stores, Inc.» of the Supreme Court of the United States, in which the plainti-’s right to wear a head scarf prevailed over Abercrombie’s freedom of contract. The author concludes that there is still debate whether to impose the rules of the country on migrants or whether the receiving countries should adapt to new customs
