When children go missing, their relatives immediately start looking for him. The reasons can be very different: runaway, stray, kidnap, or several crimes. However, the actions carried out by the authorities are usually delayed and the measures taken are inadequate and insufficient to find their whereabouts. As consequence, children and adolescents continue to disappear throughout the years and are unable to be reunited with their families due to the State?s inability to investigate what happened. This work is intended to inquire into International Human Rights Law to find an answer to the reality of those children and adolescents who disappear. From this perspective, I will seek to identify the States? obligations in these situations and the standards regarding investigation, identification and restitution, in order to have clear criteria when demanding compliance from the authorities

Cuando un niño desaparece de su hogar, sus padres inmediatamente comienzan a buscarlo. Las razones pueden ser muy diferentes: fuga, extravío, secuestro o diversos delitos. Sin embargo, el accionar de las autoridades usualmente se ve demorado y las medidas que se toman resultan ser inadecuadas e insuficientes para dar con su paradero. El resultado son niños, niñas y adolescentes que a lo largo de los años continúan desaparecidos y sin poder reencontrarse con sus familias a causa de la incapacidad de Estado para investigar lo sucedido. El presente trabajo se propone indagar en el Derecho Internacional de los Derechos Humanos para encontrar una respuesta para la realidad de aquellos niños, niñas y adolescentes que desaparecen. Desde esta perspectiva buscaremos identificar cuáles son las obligaciones que los Estados tienen frente estas situaciones y los estándares en materia de investigación, identificación y restitución, de modo de tener criterios claros al momento de exigir su cumplimiento a las autoridades
