Las buenas intenciones: burocracias judiciales y judicialización del conflicto ambiental en el área metropolitana de Buenos Aires (2004-2024)

El objetivo de este artículo es indagar en los efectos de un litigio estructural de saneamiento ambiental en la cuenca más contaminada y poblada de Buenos Aires, dentro del Poder Judicial. Así, se pretende poner en tensión los abordajes sobre la judicialización del conflicto social y aquellos que analizan las burocracias judiciales. A su vez, el devenir de este caso da cuenta de las transformaciones políticas ocurridas en este campo durante el período 2004-2024 en Argentina. Se llevó adelante una metodología cualitativa que consistió en el relevamiento de resoluciones y documentos judiciales, así como en entrevistas en profundidad a operadores jurídicos intervinientes en la causa.
The objective of this article is to investigate the effects of a structural environmental sanitation lawsuit in the most polluted and populated basin of Buenos Aires, within the Judicial Branch. Thus, it aims to highlight the tension between approaches to the judicialization of social conflict and those that analyze judicial bureaucracies. At the same time, the evolution of this case reflects the political transformations that took place in this field during the period 2004-2024 in Argentina. A qualitative methodology was used, consisting of a survey of judicial decisions and documents, as well as in-depth interviews with legal practitioners involved in the case.
O objetivo deste artigo é investigar os efeitos de um litígio estrutural de saneamento ambiental da bacia mais poluída e populosa de Buenos Aires, no âmbito do Poder Judiciário. Busca-se, assim, colocar em tensão as abordagens sobre a judicialização do conflito social e aquelas que analisam as burocracias judiciais. Por sua vez, a evolução desse caso esteve associada às transformações políticas ocorridas nesse campo entre 2004 e 2024 na Argentina. Adotou-se uma metodologia qualitativa, que incluiu a análise de resoluções e documentos judiciais, bem como entrevistas em profundidade com operadores jurídicos envolvidos no caso.
