Realidad social y Derechos Humanos: Una crítica sustantiva a John Searle

La teoría de la sociedad –o como Searle la llama, la filosofía de la sociedad- tiene la capacidad de analizar la totalidad de hechos institucionales. Debe poder analizar todos los problemas en todas las épocas históricas. En el presente trabajo afirmaremos que la ontología social de John Searle, con su formalización, “X cuenta como Y en el contexto C” (1995; 2004; 2010), logra cumplir ese objetivo. Si bien estamos de acuerdo, en términos generales, en sus elaboraciones teóricas, nos distanciamos del modo en que analiza un caso particular: los Derechos Humanos. En la primera parte de nuestro trabajo expondremos brevemente los elementos que componen su teoría de la realidad social; posteriormente, y reconstruyendo las críticas que Ernst Tugendhat elabora en lo referido a la no ampliación de los Derechos Humanos, nos dedicaremos a analizar el contexto en el que han surgido esos Derechos y las tradiciones teóricas que han reflexionado al respecto. Finalmente llevaremos a cabo una crítica sustantiva a la posición libertaria de John Searle, sosteniendo que los Derechos Humanos socio-económicos no sólo poseen una existencia real sino que también deben tener jerarquía constitucional en cada gobierno en particular porque aquello que está en juego es la dignidad humana. Nos encontramos frente una problemática que representa uno de los grandes desafíos para el Siglo XXI.
The theory of society, or as Searle calls, philosophy of society has the ability to analyze all institutional facts. It must be able to analyze all problems in all historical periods. In this paper we affirm that social ontology of John Searle, with its formalization, “X counts as Y in context C” (1995; 2004; 2010), achieves that goal. While we agree, in general terms, in their theoretical elaborations, we distance ourselves from analyzing how a particular case: Human Rights. In the first part of our work briefly we discuss the elements of his theory of social reality; subsequently rebuilt and Ernst Tugendhat criticisms made with regard to the nonextension of Human Rights, we will work to analyze the context in which those rights have emerged and the theoretical traditions that have thought about it. Finally we take out a critical substantive critique to the libertarian position of John Searle, holding that Human socio-economic Rights not only have a real existence but must also have constitutional status in each particular government because what is at stake is the human dignity. We are facing a problem that represents one of the major challenges for the XXI century.
