Análisis de las Instituciones y legislación de la provincia de La Pampa en materia de Infancia desde una perspectiva histórica. 1960-2010

A partir del estudio que venimos desarrollando acerca de la historia de las instituciones que han albergadoniños en riesgo en la provincia de La Pampa (delegación Zona Norte. 1960-2010), consideramos de fundamentalimportancia el análisis del rol del Poder Judicial en materia de infancia en el periodo de estudio. Esta investigaciónpuede ser considerada un estudio ex - post facto retrospectivo, de acuerdo con la clasificación de Montero yLeón (2002, 2005), en el sentido de que no es posible manipular variables. Desde el estudio de las institucionesde niños y su vínculo con el Poder Judicial es posible señalar dos grandes etapas en relación a esta vinculación:la primera, desde el inicio de las macro-instituciones, alrededor de 1960, hasta el año 1990 y la segunda desde1990 hasta el 2010. El punto de inflexión lo marcaría la sanción de la Ley Nº 1270 a través de la cual se creó elFuero de la Familia y el Menor en el Poder Judicial. Analizando la situación de La Pampa en materia legislativa,en funcionamiento institucional y del rol del Poder Judicial se advierte que, en los hechos, en la provincia hay unaconvivencia de las dos grandes doctrinas de infancia, porque si bien desde el Poder Judicial se procura intervenirdesde la Ley de Protección Integral, no se han producido modificaciones desde la estructura institucional de losórganos administrativos, ni cambios legislativos acordes con ello.
In this study, we consider that the analysis of the role of the Judiciary in childhood matters is of paramount significance. This is derived from the research work we conducted about the history of the institutions hosting children at risk in the province of La Pampa (North Zone delegation. 1960-2010). This research study can be considered an ex-post facto retrospective study, according to the classification by Montero and León (2002, 2005), in the sense that it is not possible to manipulate variables.Considering the study of institutions for children and their link with the Judiciary, it is possible to identify two major stages in this relationship: the first one, from the beginning of the macro-institutions, from around 1960 to 1990, and the second one, from 1990 to 2010. The turning point would be the enactment of Law No. 1270, through which the Family and Minors Court was created.The analysis of La Pampa in terms of its legislative situation and the institutional and operational roles of the Judiciary show that, in fact, two great childhood doctrines coexist in the province. Although the Judiciary tends to act considering the Integral Protection Law, there have been neither changes in the institutional structure of the administrative departments, nor legislative changes consistent with that.
