El acto de gobierno en la impronta constitucional cubana

En el proceso de conformación del Derecho Público, el acto de Gobierno ha devenido en atractiva categoría para el binomio Constitucional- Administrativo. En el artículo se analiza la jurisprudencia del Consejo de Estado francés básica para la configuración actual de la institución, así como las diferentes teorías en las que descansa su esencia: el riguroso sentido del móvil político, la libertad soberana del órgano del cual dimana y la exclusión del control contencioso. La historia constitucional cubana provee de los elementos que permiten comprender su configuración actual. Con el surgimiento en 1868 de un Gobierno centrado en la preponderancia del Legislativo sobre el Ejecutivo y la Constitución de Baraguá luego se inician las idas y venidas de la conformación del Acto de Gobierno marcando la evolución de la institución y sus matices en un análisis de sus principales hitos constitucionales.
In the process of shaping Public Law, the act of Government has become a category of attractive appeal for the Constitutional-Administrative binomial. The article analyzes the jurisprudence of the French Council of State for the current configuration of the institution, as well as the different theories on which its essence rests: the rigorous sense of the political motive, the sovereign freedom of the organ from which it arises and the exclusion from contentious control. The cuban constitutional history provides the elements that allows us to understand its current configuration. Following the emergence in 1868 of a Government centered on the preponderance of the Legislative over the Executive, and after the Baraguá Constitution enhanced the role of the Government Act. From this norm and the evolution of the institution will be establishing their nuances in an analysis of the main constitutional moments.
