En el presente trabajo me propongo abordar una de las principales construcciones teóricas del Dr. Eugenio Zaffaroni: la dialéctica entre Estado de Derecho y Estado de policía. El análisis se centra en el método a partir del cual el autor se enfrenta al problema de la organización política en el sistema social capitalista. Pretendo también identificar los datos fácticos y las herramientas teóricas puestas en juego, indagar sobre la tarea estratégica que plantea, y al mismo tiempo señalar su utilidad científica y política.
In this paper, I aim to explore one of the main theoretical constructs of Dr. Eugenio Zaffaroni, the dialectic between Right State and Police State. The analysis focuses on the method the author uses for facing the problem of political organization in the capitalist social system. I also propose to identify the facts and the theoretical tools involved, and to investigate the strategic task posed, as well as stressing its scientific and political utility.
