La impunidad del estado en la violación de derechos humanos perpetrada por sus agentes

El presente artículo tiene como objetivo abordar la impunidad consagrada por el Estado, mediante mecanismos de iure o de facto que impiden la investigación, juzgamiento y sanción de los delitos cometidos por agentes estatales. Se tratará los delitos violatorios de los derechos humanos, excluyendo los que se configuran dentro del concepto de Lesa Humanidad. Comenzaremos analizando la noción de impunidad, estudiando el alcance de los mecanismos que incurren en tal finalidad, así leyes de amnistía, prescripción, indultos, cosa juzgada fraudulenta, la justicia militar, entre otros. Para terminar, se estudiarán los parámetros establecidos por la jurisprudencia de la Corte Interamericana de Derechos Humanos y el Tribunal Europeo de los Derechos Humanos en tales temáticas.
This article has as objective to address the enshrined impunity by the State, which through de jure or de facto mechanisms prevent the inquiry, the prosecution and the penalty for offences committed by official agents. Special attention will be placed on crimes against human rights, but excluding those included in the concept of crimes against humanity. We will start analyzing the notion of impunity, the facilitators whereof impunity prevails, as amnesty laws, the prescription regime, pardon, the fraud of the res judicata, the military justice, etc. To sum up, the established parameters by the recent jurisprudence of the Inter-American Court of Human Rights and the European Court of Human Rights will be studied.
