El agente marítimo, sus funciones y la responsabilidad en los reclamos de índole laboral

El agente marítimo realiza una serie de funciones vinculadas al ingreso, permanencia, aprovisionamiento y salida del buque en un puerto determinado, siendo designado tanto por el capitán, el propietario o armador del buque con quien se encuentra vinculado a través de un contrato de mandato. La normativa especial le otorga un carácter de representante legal, ostentando de este modo la legitimación activa y pasiva, judicial y extrajudicial de su mandatario en todos los reclamos a favor o en contra de este. La intervención en todas las gestiones se hace dentro de la vinculación contractual comentada, entonces los negocios que se conciertan lo son en representación o en nombre de su mandatario, por lo que no se encuentra alcanzado por la responsabilidad que emana de posibles incumplimientos o deven- gamiento de acreencias, a excepción de aquellos incumplimientos contractuales en los que incurra. En principio, la acción judicial en materia de litigios laborales dirigida directamente contra el agente marítimo no alcanza su patrimonio, salvo el caso de fraude laboral o de no haber podido acreditar su condición de representante del capitán, propietario o armador del buque, en su presentación.
