Resumen: El presente artículo busca ofrecer una presentación general del oficio de juez eclesiástico a partir de las normas conciliares y sinodales y de la doctrina de los autores más importantes. Para ello, en primer lugar, se trae a colación el postulado esencial que se ha de considerar al estudiar el oficio de juez en el Antiguo Régimen: su función no consiste en aplicar una norma sino en resolver con justicia el caso a él sometido. Luego, se analizan los diversos requisitos y características establecidas por el derecho canónico indiano para el ejercicio de la función judicial en la Iglesia. La impostación descriptiva del artículo tiene por objeto ofrecer los elementos fundamentales que regían la actividad jurisdiccional en la Iglesia americana en el período hispano.
Abstract: The present article offers a presentation of the Ecclesiastical judge’s craft depart from conciliar and synod norms and the doctrine of the most relevant authors. In order to achieve this, in first place the essential postulate to study the craft of judge in the Old Regimen is taken into account: its function is not to apply the rule but to solve with justice the case to him submitted. Thereupon, various requirements and characteristics established by the Canonic Law in the Spanish America for the exercise of the judicial function in the Church are analyzed. The article’s descriptive tone aims to provide the key elements governing jurisdictional activity in the American Church during the Spanish period.
