Libertad religiosa: nuevos matices en la jurisprudencia norteamericana

Resumen: presente texto analiza las dos interpretaciones que la jurisprudencia y doctrina norteamericanas han realizado sobre la Primera Enmienda de la Constitución estadounidense que consagró el denominado muro de separación entre Iglesia y Estado. Tales interpretaciones son, por un lado, la del establishment clause, y, por el otro, la de free exercise. Ambas han sido aplicadas por la Corte Suprema de Justicia de Estados Unidos a la hora de resolver los conflictos suscitados en torno a la libertad religiosa. Luego el texto realiza, a partir de tales casos, una clasificación temática sobre la jurisprudencia norteamericana en la aplicación de la Primera Enmienda.
Abstract: This paper analyzes the two interpretations American jurisprudence and doctrine have done on the First Amendment of the US Constitution which enshrined the so-called wall of separation between Church and State. Such interpretations are on the one hand, the establishment clause, and, on the other, that of free exercise. Both have been applied by the Supreme Court of the United States in resolving conflicts arising around Religious Liberty. Then the text makes, from such cases, a thematic classification on American jurisprudence in the application of the First Amendment.
