La intervención federal es un instrumento de excepción y de emergencia, atribuido al gobierno nacional sobre las provincias y la Ciudad Autónoma de Buenos Aires, cuya finalidad es el mantenimiento de la supremacía de la Constitución Nacional; de los Tratados de Derechos Humanos que integran el bloque de constitucionalidad; de las leyes federales; y de las instituciones políticas provinciales. Entre las causales que dan lugar a la intervención federal, se encuentra el supuesto en el cual el gobierno federal actúa por sí solo y dispone la medida con la finalidad de garantizar la forma republicana de gobierno. Cuando alega dicha hipótesis y, en definitiva, la medida excepcional encubre otros propósitos, se produce una grave lesión al ejercicio de los derechos políticos de los ciudadanos. Ante tales hechos, los controles de constitucionalidad y convencionalidad actúan como garantes del ejercicio de aquellos.
The Federal intervention is an instrument of exception and of emergency, attributed to the national government on the provinces and the Autonomous City of Buenos Aires. Its purpose is the maintenance of the supremacy of the National Constitution; of the Treaties of Human rights that integrate the constitutionality block; of the federal laws; and of the provincial political institutions. Among the grounds that give place to federal intervention, there is the assumption in which the federal government acts by itself and arranges the measure in order to ensure the republican form of government. When the above-mentioned hypothesis is alleged and finally the exceptional measure conceals other intentions, a serious injury takes place to the exercise of the political rights of the citizens. Before such facts, constitutionality and conventionality controls act like guarantors of the exercise of those rights.
