El objetivo de este artículo es analizar la normativa aplicable a la extracción de hidrocarburos no convencionales por el mecanismo de fracking en Argentina. Metodológicamente se analizan en primer lugar las normas constitucionales involucradas y en segundo lugar, la legislación nacional pertinente. Se considera también la distribución de competencias entre el Estado Federal y las provincias.
The aim of this article is to analyze the normative applicable to the extraction of unconventional hydrocarbons by the mechanism of fracking in Argentina. Methodologically, first, the constitutional rules involved are analyzed and secondly, the relevant national legislation. It is also considered the distribution of powers between the Federal State and the provinces.
