Este artículo busca describir los cambios y aportes en el instituto de la filiación que contiene el Proyecto de Reforma Código Civil y Comercial 2012 en Argentina, contextualizando el análisis en el marco de la visión constitucionalizada del Derecho Privado que se desarrolla a partir de la reforma de la Constitución nacional en el año 1994. Con este objeto, se parte del análisis de la filiación y sus fuentes en el Derecho vigente, reflejando las carencias normativas y axiológicas que el régimen presenta. Para definir si la norma proyectada logra superar las lagunas, se definió el alcance de los principios estructurales del Proyecto en el instituto de la filiación. Seguidamente, se acompaña una reseña de las disposiciones generales para luego ingresar en los aspectos particulares que comprende tanto a la filiación por naturaleza como a la filiación por técnicas de reproducción humana asistida: determinación de la maternidad, determinación de la filiación matrimonial y extramatrimonial, supuestos especiales que se trasladan a la norma, como la gestación por sustitución y la filiación post mortem
This article seeks to describe the changes and contributions to the institute of filiation which contains the project of the reform Civil and Commercial Code 2012 in Argentina, contextualizing the analysis under the vision of Private Law constitutionalized that develops the reform about the Constitution in 1994. For this purpose that begins from the analysis of the filiation and its sources in the current law, in order to show the normative and axiological shortcomings that the regimen presents. To determine whether the proposed rule achieves to receptor gaps, it is defined the scope of the structural principles of the Project at the Institute of sonship. Then accompanied a review of the general provisions and then enter to the particular aspects comprising both the Natural filiation as to assisted human reproduction techniques: determination of maternity, determination of the matrimonial and extramatrimonial filiation, special assumptions moving to the norm, as substitution gestation and postmortem filiation
