La violencia revolucionaria ante la Justicia: nuevos problemas y desafíos historiográficos

En agosto de 1974, el oficial del Ejército Argentino del Valle Larrabure fue secuestrado por el Ejército Revolucionario del Pueblo (ERP) durante el asalto de esta organización a la fábrica Militar de Pólvora y Explosivos de Villa María, Córdoba. Un año más tarde, el cuerpo sin vida de Larrabure aparecía en la vía pública, en la ciudad de Rosario. La causa en la que se investigaba su muerte prescribió hacia 1990. Sin embargo, desde 2007, sus familiares han solicitado su reapertura, sosteniendo que la muerte de Larrabure constituye un delito de lesa humanidad y es, por tanto, imprescriptible. Luego de varios fallos por la negativa, la querella presentó una queja ante la Corte Suprema de Justicia donde actualmente se encuentra a la espera de tratamiento. La primera parte del artículo presenta una breve síntesis de los hechos referidos al secuestro y la muerte de Larrabure; la segunda, se centra en el recorrido judicial de la causa relativa a su muerte, atendiendo principalmente a las figuras jurídicas allí implicadas; y, finalmente, el artículo se propone explorar y reflexionar sobre las tensiones y vínculos entre historia, justicia y política que el caso representa.
In August 1974, the army´s officer Argentino del Valle Larrabure was kidnapped by the People's Revolutionary Army [ERP], during the assault of this organization on the explosives and gunpowder army's factory in Villa María, Córdoba. One year later, Larrabure’s lifeless body appeared on the public roads, in the city of Rosario. The cause in which his death was investigated prescribed toward 1990. However, since 2007, his relatives have requested its reopening, arguing that Larrabure's death constitutes a crime against humanity and it is, therefore, imprescriptible. After several rulings refusing, the prosecution filed a complaint before the Supreme Court Justice where it is currently awaiting treatment. The first part of the article presents a summary of the facts related to Larrabure's kidnapping and death. The second one focuses on the judicial review of the case related to his death and that it mainly attends to the legal figures involved there. Finally, the article sets out to explore and to reflect on the tensions and connections between history, justice and politics that the case represents.
